| HB 72 | Extending The Commission to Study Telehealth Services. Edwards introduced the bill and noted this is the same bill as in previous years except for the adding language on line 8 and 14. Previous study commission was heavily influenced by Covid and the committee did not feel the study and data was skewed and limited due to the environment during the year of the study. There was some committee discussion about integrating this bill with other technology study committees. Edwards advised that this would be separate and more focused on access, cost and quality of care. NAMI provided testimony in support. No opposition. It is the majority opinion of the Health, Human Services and Elderly Affairs Committee that one of the most important medical innovations to come of out of the recent COVID pandemic was the advent of telemedicine as a means of providing increased access for patients to medical care, especially for those with transportation challenges. The committee realizes this modality of care is evolving and being challenged by changes in federal policy. Therefore, it is critical the state remain in an adaptive mode. The Telemedicine Commission is critical for allowing the state to do this important work. Furthermore, the committee is pleased to see the legislation refers to synchronization with federal policy. | HB 476 | Relative to Restrictions On Elective Abortion. This bill clarifies the definition of “fetus” for the purpose of abortion laws. The bill leaves in statute the subdivision located at RSA 329:43 through RSA 329:50 which makes abortions illegal after 24 weeks gestational age except in the case of a medical emergency or a fetal abnormality incompatible with life, but adds an additional differing subdivision that makes abortions illegal after 15 weeks gestational age except in the case of a medical emergency or a fetal abnormality incompatible with life. This bill also adds that no regulatory or law enforcement agency has the authority to penalize a health care provider for performing an abortion before 15 weeks gestational age except as specifically provided by law. This bill was re-introduced from previous year. Indicated this bill is necessary due to 46 other states that collect abortion data-NH does not, also concerned that abortion providers in NH misrepresent data such as the use of ultra-sound, number of and certain types of abortion as well as gestational age. NH deserves access to this data to make decisions. Sen. Prentis asked why in Section II the information reported must be written? Avard responded that he could not answer that "yet'. Prentis made the point that NH holds privacy data at high standards and asked if NH refused to share data? Avard answered because it was not collected. Trish Tilley from the Dept no position but gave a thorough overview of the impact this bill would have on the departments with respect to IT, workforce, data collection gaps, no authority to collect data, and the codes used for such "terminations, HIPPA and the fact that a new system to collect this data would need to be built, implemented and supported. She gave estimates of $950 thousand with an extra $250 thousand to connect with OPLC's verification of licensing along with 1-2 FTEs for management & analysis of data and a .5 FTE for IT support. She indicated the concern of the privacy of data collected in the bill and how easy it may be to constructively identify information by breaking down to a personal level. This bill was a request from DOI to clarify RSA 415:22 First enacted in 1975 to insure a child has insurance coverage for first 31 days. Michelle Heaton Director of Life & Health at Ins. Dept. discussed and answered questions with respect to the details of various scenerios that included parents who may be unmarried or divorced with and without insurance-who would be primary coverage. She cited DOI"s guidance issue publication used by carriers. indicated that "99% of insurance carriers are on top of the coverage for baby and mom . Most plans must cover newborns if commercial plan. Also noted that if a child has a health issue, they can not factor that in on the premium and baby would be cared for as part of the essential benefit and medically necessary services. Briana Hinkle-New Futures testified in support Paula Roger testified in support but indicated some sections may need to be clarifed.
