This bill was put in on behalf of the Board of Dental Examiners and stems from a 2017 Board Audit by the state. The audit indicated discrepancies between the practice of dental hygiene with respect to providing local anesthesia- The language in statue and rules were not in sync. This bill cleans that up. Rep Spillane introduced the bill. This is the exact bill from last session which went through house-senate-house and then OTL due to some bipartisan language concerns. Concerns addressed in the bolded portions of the bill. Lots of conversation on anonimous callers who frequently report and those who are required to report due to professions. Susan Larrabee DCYF No postion. Recognizes the committee's need to balance the civil & criminal with good faith. In the bill, DCYF are the ones who recommended the change in line 12 from "Shall" to "May" Also pointed out that out of 27K callers about 1K were anonimous. All others were willing to give name and contact information for further follow up. Emily Lawerence, Waypoint. Oppose bill. Concerns. Chilling effect on average reporters that they may be in trouble and not feel inclined to report. Domestic Violence offenders may weaponize this bill against the victims. Suggested to look at other approaches rather than criminal prosecutions for ex. misdeamor or gradual punishement with warnings and then a fine etc. States with penalities have not discouraged. Concerns-chilling effect , Support the anonimoous reporting, Bill construction issues-lots of terms need to be clarified and/or define better and who will police/enforce this? Notices that there a not alot of malicious reporters. Screeners are highly trained and are able to sift through those. OCA already works with families w/ frequent flyer reporting in highly contentious divorce or DV due to being supeona.
